Lawsuit Filed Against Illinois Transgender Policy

CHICAGO – Lauren Grey says she is a woman. Her driver’s license, Social Security card and her appearance also say so.

The American Civil Liberties Union has sued the Illinois Department of Public challenging the rules it follows to change the gender on a birth certificate.

John Knight of the ACLU’s Lesbian, Gay, Bisexual and Transgender Project says for years the state would change people’s gender on their birth certificates even if they had not had any form of genital surgery. He says now they are saying it has to be genital surgery.

Health Department spokeswoman Kelly Jakubek says the department won’t comment because of the ongoing litigation.

Grey tells the Chicago Tribune she began sex reassignment treatment in 2001. Her birth certificate continues to say she’s a man.
